LEGAL NOTICE TO BIDDERS
REHABILITATE RUNWAY 5-23, PHASE XI (DESIGN) – (PHASE H CONSTRUCTION)
MORRISTOWN MUNICIPAL AIRPORT
NOTICE is hereby given that sealed bids will be received by the Business Administrator of the Town of
Morristown, in the County of Morris, State of New Jersey (the “Town” or, as the case may be, the “Sponsor”
or “Owner”) on Wednesday, May 20, 2026, at 10:00 a.m., prevailing time for the following:
REHABILITATE RUNWAY 5-23, PHASE XI (DESIGN) – (PHASE H CONSTRUCTION) at
MORRISTOWN MUNICIPAL AIRPORT
Sealed bid proposals will be received at the Morristown Town Hall, 200 South Street, 2nd Floor, Room 201,
Morristown, NJ, 07960 until May 20, 2026, at 10:00 A.M. (the “Receipt Deadline”), at which time they will
be publicly unsealed and the contents publicly announced in Room 201. N.J.S.A. 40A:11-23(a) prohibits bids
being publicly opened on a Monday or the day after a holiday.
Unless a form included in the Bid Documents expressly specifies otherwise, all bid proposals must be
submitted on the Proposal Forms provided in the Bid Documents and must be enclosed in a sealed opaque
envelope, with the name of the Bidder and the name of the project plainly and clearly marked on the outside as
follows:

When sent by mail, preferably certified mail, the sealed bid proposal, marked as indicated above, shall be
enclosed in an additional envelope. No bid will be accepted after the Receipt Deadline specified above. The
Town shall not be responsible for any bid not delivered in person to Morristown Town Hall, 200 South Street,
2nd Floor, Room 201, Morristown, NJ, 07960 at or before the Receipt Deadline. The Town shall award the
Contract or reject all bids within 60 days of bid opening, except that the bid of any bidder who consents thereto
where indicated in the bid documents, may be held for consideration for such longer period as may be agreed,
but in no event exceeding 210 days without further consent.
The Town will evaluate bids and any award will be made to the lowest, responsive, responsible bidder in
accordance with N.J.S.A. 40A:11-6.1.
Plans and specifications will be available and can be purchased at www.deltaairport.com.
Plans and specifications are available for purchase in both hardcopy and digital (PDF) formats.
A Pre-Bid Conference will be held in the Airport’s Multi-Purpose/Conference Room (Building 8C) on
April 29, 2026 at 10:00 A.M.
All prospective bidders are highly encouraged to attend the Pre-Bid Conference to discuss the proposed
construction and the plans and specifications.
Bidders may visit the project site by prior appointment with DM AIRPORTS, LTD., operators of Morristown
Municipal Airport. To schedule a project site visit appointment, contact Felicia Coppola, Projects
Administrator, at (973) 538-6400.
A Proposal Guaranty—in the form of either a Cashier’s check drawn upon a state or national bank or a Proposal
Bond with a Surety’s Bond Affidavit and in the penal sum of five percent (5%) of the total maximum bid
amount—will be required with each bid proposal. After the bids are publicly opened the Proposal Guaranty of
the two (2) apparent lowest responsible bidders will be retained until a final award is made. All other Proposal
Guaranties will be returned to the bidder that proffered it within ten (10) days after the opening of bids, unless
otherwise requested by the bidder. After the contract has been awarded and executed, the unsuccessful bidder’s
Proposal Guaranty will be returned as soon as practicable, while the Proposal Guaranty of the winning bidder
will be returned as soon as the Town receives the contract bonds as required herein. Failure to include the
requisite Proposal Guaranty, in the format prescribed herein, with your bid Proposal, is a fatal defect that will
render your bid unresponsive and require that it be rejected.
Bidders are required to comply with all relevant Federal and State Statutes, Rules and Regulations and Local
Ordinances, including but not limited to, the applicable provisions of Title VI of the Civil Rights Act of 1964,
as amended (42 USC 2000d-1 et seq.), the discrimination and affirmative action provisions of N.J.S.A. 10:2-1
through 10:2-4, the New Jersey Law against Discrimination, N.J.S.A. 10:5-1 et seq., and the rules and
regulations promulgated pursuant thereto. Pursuant to N.J.S.A. 10:5-31 et seq., bidders are required to comply
with the requirements of P.L. 1975 c. 127, N.J.A.C. 17:27.
Bidders are directed to the Proposal Forms included in the specifications, in particular the Proposal Checklist,
for identification of required Category 1 documents as well as Category 2 documents. Failure to provide
Category 1 bid documents will automatically render the bid unresponsive and require rejection of the bid.
Prospective bidders are cautioned not to rely solely on this Invitation to Bid, but to read the Bid Package in
its entirety.
Contractor and all subcontractors must comply with all applicable provisions of the New Jersey Public Works
Contractor Registration Act, N.J.S.A. 34:11-56.48 and the New Jersey Prevailing Wage Act, N.J.S.A. 34:11-
56.25.
The Town of Morristown reserves the right to reject any and all bid Proposals and to waive any informality
in bid Proposals received. Bid Protest procedures shall be governed by the New Jersey Local Public Contracts
Law N.J. Stat. § 40A:11-1. et seq.
